SMARTLINK TECHNOLOGIES (PTY) LTD — DELIVERY & COLLECTION POLICY
Covering Delivery, Installation and Return of Leased ICT Equipment
Last updated: [DATE]
Because SmartLink leases equipment rather than selling it outright, this policy covers equipment out to you at the start of a lease and back to us at the end of one — not a retail "shipping" process. It should sit alongside the Terms of Use and the applicable Lease Agreement.
1. Scope
This Delivery & Collection Policy applies to all ICT and business technology equipment supplied by SmartLink under a signed Lease Agreement, including delivery, installation/setup (where included), and end-of-lease collection or exchange. It does not apply to Managed IT Services performed remotely, which are governed by the applicable SLA.
2. Delivery Areas
- SmartLink delivers to business premises within South Africa. Standard delivery covers [Gauteng / list serviced provinces]; delivery outside this area may be available at an additional cost, to be confirmed in your quotation.
- Delivery is made to the business address confirmed in your signed Lease Agreement. Redirecting delivery to a different site must be requested in writing and may affect delivery timelines or incur additional charges.
3. Delivery Timelines
- Estimated delivery timelines are provided in your Lease Agreement or order confirmation and typically range from [X–X business days] from the date of signature, subject to equipment availability.
- Timelines are estimates only and are not guaranteed. SmartLink is not liable for delays caused by couriers, customs, manufacturer stock shortages, or other circumstances outside our reasonable control.
- Large or specialised orders (e.g. server infrastructure, bulk device rollouts) may require a longer lead time, which will be communicated separately.
4. Installation & Setup
- Where installation, configuration or setup is included in your Lease Agreement or SLA, this will be scheduled with your business following delivery, at a mutually agreed date and time.
- The client is responsible for ensuring reasonable site access, power, network connectivity and a suitable environment for installation. Delays caused by site readiness are not the responsibility of SmartLink and may result in rescheduling and/or additional charges.
- Basic delivery without installation includes drop-off at the confirmed business address only; the client is responsible for unpacking and setup unless otherwise agreed.
5. Risk and Inspection on Delivery
- Risk in the equipment (though not ownership — see Terms of Use, clause 2.1) passes to the client upon delivery to the confirmed address.
- The client must inspect equipment on delivery and report any visible damage, shortages or incorrect items to SmartLink within [48 hours] of delivery. Claims reported after this period may not be accepted.
6. Delivery Charges
- Delivery charges (if any) are quoted separately from monthly rental fees and will be set out in your Lease Agreement or invoice.
- SmartLink reserves the right to adjust delivery charges for out-of-area, urgent, or after-hours delivery requests, communicated in advance.
7. Equipment Exchange & Upgrades
- Where your Lease Agreement includes scheduled upgrades or equipment refreshes, replacement equipment will be delivered and outgoing equipment collected in the same visit wherever possible, to minimise business disruption.
- Loaner/temporary equipment may be provided at SmartLink's discretion while a repair or replacement is in progress, where covered by your SLA.
8. End-of-Lease Collection
- On expiry, cancellation or termination of a lease, SmartLink will arrange collection of the leased equipment from the confirmed business address within [X business days], or as otherwise agreed in the Lease Agreement.
- The client must make the equipment reasonably available for collection, in the condition required by the Lease Agreement (fair wear and tear excepted). Failure to make equipment available for collection may result in continued rental charges and/or replacement-value billing, as set out in the Lease Agreement.
- Equipment must be returned complete with accessories, chargers, and any peripherals supplied as part of the lease, unless otherwise agreed.
9. Damaged, Lost or Stolen Equipment
- The client is responsible for leased equipment for the duration of the lease term, as set out in clause 4 of the Terms of Use and the applicable Lease Agreement.
- Loss, theft or damage beyond fair wear and tear must be reported to SmartLink immediately and may result in repair, replacement or loss charges being billed to the client, in accordance with the Lease Agreement.
10. Failed Deliveries & Access Issues
- If delivery or collection cannot be completed due to no one being available to receive/release equipment, incorrect address details, or restricted site access, SmartLink may charge a reasonable re-delivery/re-collection fee.
- SmartLink will make reasonable attempts to contact the client to reschedule before applying any such fee.
